1. WHO WE ARE
These Terms and Conditions (“Terms”) govern all services provided by Flourishing Life LLC, operating under Mind Over the Market™ and Dr. Sophie Keller, known as The Trading Psychologist™ (“Company,” “we,” “us,” or “our”).
By purchasing, accessing, or using any program, coaching, content, or service, you agree to be legally bound by these Terms.
2. ELIGIBILITY
You must be at least 18 years old. By using this Service, you confirm you have legal capacity to enter into this agreement.
3. NATURE OF SERVICES
All services are educational and informational only, including:
- Mind Over the Market™ program
- Private coaching sessions
- Digital materials and training
- Live and recorded sessions
4. NO FINANCIAL OR INVESTMENT ADVICE
Nothing provided constitutes financial, investment, legal, or trading advice.
You are solely responsible for:
- All trading decisions
- All financial outcomes
- All profits and losses
You agree that the Company is not responsible for any financial result or outcomes.
5. PAYMENT TERMS
All payments are:
- Due in full at time of purchase unless otherwise stated
- Non-refundable except as explicitly outlined below
Failure of payment authorization voids access.
6. REFUND POLICY (STRICT)
Mind Over the Market™ ONLY:
Refund eligibility requires BOTH:
1. Attendance at the live Week 1 session
2. Written refund request within 24 hours of that session
If BOTH conditions are not met:
→ NO REFUND will be issued under any circumstances.
Additional conditions:
- Watching a replay does NOT qualify as attendance
- Failure to attend forfeits eligibility
- Continued access beyond Week 1 constitutes full acceptance
7. PRIVATE COACHING (STRICT)
- All private sessions are NON-REFUNDABLE once booked.
- Minimum 24 hours’ notice required to reschedule
- Missed or late-cancelled sessions will be charged at 50% of the session fee.
8. PROGRAM DELIVERY & ACCESS
The Company reserves full discretion to:
- Modify program structure, content, or delivery
- Change dates, times, or format
- Update or remove materials
We do not guarantee uninterrupted access to the Service or that all features will be available at all times.
Access:
- May be time-limited
- May be revoked at any time for breach
- Recordings are NOT guaranteed indefinitely.
Access to session recordings, if provided, is temporary, limited, and may be modified or removed at any time at the Company’s sole discretion. No guarantee is made regarding duration of access.
9. INTELLECTUAL PROPERTY (ZERO TOLERANCE)
All content is proprietary.
You are STRICTLY PROHIBITED from:
- Recording (audio, video, screenshots)
- Copying or reproducing content
- Sharing login access
- Teaching or repurposing material
- Using frameworks, language, or systems commercially
- Distributing to any third party
Violations:
We enforce a strict zero-tolerance policy for any unauthorized use or distribution of our content.
Any violation will result in immediate termination of access, without refund, and may result in legal action, including but not limited to claims for damages, injunctive relief, and recovery of legal costs.
10. CHARGEBACKS & PAYMENT DISPUTES
By purchasing, you agree:
- Not to initiate chargebacks without first contacting support
If a chargeback or payment dispute is initiated
- Access to the Service will be immediately revoked
- You remain liable for the full payment
- You agree to reimburse all fees costs and recovery expenses incurred by the Company
- We reserve the right to pursue collections and legal action
You agree that initiating a chargeback or payment dispute in violation of these Terms constitutes a breach of contract
11. ACCOUNT SECURITY
You are responsible for:
- Maintaining login confidentiality
- All activity under your account
12. NO GUARANTEES
We make NO guarantees regarding:
- Financial outcomes
- Trading success
- Personal transformation
All results depend solely on you.
13. LIMITATION OF LIABILITY (MAXIMUM PROTECTION)
To the fullest extent permitted by law:
- We are NOT liable for any:
- Trading losses
- Financial losses
- Indirect or consequential damages
- Loss of business or opportunity
Total liability is strictly limited to the amount paid for your service.
14. “AS IS” DISCLAIMER
All services are provided “AS IS” with NO WARRANTIES of any kind.
15. TERMINATION
We may terminate access immediately, without notice, if:
- Terms are violated
- Misuse is detected
No refunds will be issued.
16. THIRD-PARTY SERVICES
We are not responsible for failures or issues related to third-party platforms.
17. GOVERNING LAW
These Terms are governed by the laws of California, United States.
18. DISPUTE RESOLUTION
You agree to attempt resolution by contacting:

We may update these Terms at any time. Continued use constitutes acceptance.
